Revista “Medierea Tehnica si Arta” continua parteneriatul media cu ICC Paris prin sustinerea celei de-a 5-a Conferinta Internationala de Mediere (2014) si a Competitiei Internationale de Mediere Comerciala (2015) organizate de ICC Paris. Acesta este al doilea parteneriat incheiat cu ICC Paris, primul datand din anul 2013.

Medierea Tehnica si Arta” is delighted to inform you of its collaboration with the International Chamber of Commerce for the 5th ICC International Mediation Conference. which will take place on 18 September 2014 at ICC's global Headquarters in Paris.

The Conference is a renowned annual event which offers a unique forum for more than 100 users of commercial mediation to exchange best practices and know-how. It provides an opportunity for company representatives to discuss techniques for effective conflict management, dispute avoidance, early dispute resolution and the efficient use of mediation.

This one-day event is attended by and especially tailored to the needs and interests of in-house counsel worldwide and it includes presentations, round table discussions and group exercises.

The title of this year’s Conference is “Plan to Succeed - Preparing for settlement in complex commercial disputes".

In economically challenging times, it is paramount to protect a company’s business interests and reduce the risk, time and costs of possible dispute resolution. Title: 1st New ICC Mediation Rules Workshop
Date: 17 September 2014

Description:

This workshop will offer participants the opportunity to acquire a comprehensive overview of the new ICC Mediation Rules. Participants will have a direct exchange with several of the members of the Drafting Group, who will give a detailed presentation of the main provisions and provide participants with first-hand experience and understanding of the new Rules. Interactive group exercises and case studies will be used to provide participants with a practical insight into how the new Rules work. All sessions will be conducted by experienced users of ICC mediation, including company representatives, counsel and mediators.

Title: 10th ICC International Commercial Mediation Competition
Dates: 6 - 11 February 2015
Venue: ICC Headquarters, 33-43 Avenue du Président Wilson, 75116 Paris

Description:

Universally recognized for its important contribution to nurturing best practices in cross-border business mediation, the ICC International Commercial Mediation Competition is the only moot devoted exclusively to international commercial mediation and is the biggest educational event organized by the International Chamber of Commerce (ICC).

During the Competition, university students face international business disputes, which they endeavor to resolve through mediation, guided by professional mediators pursuant to the ICC Mediation Rules. Their performance is evaluated by some of the world’s leading dispute resolution specialists who participate in the event as judges.

For the 10th edition of the Competition in 2015, ICC will select 66 university teams and about 120 professional mediators from more than 40 countries. The Competition will run over six days and feature around 200 mock mediation sessions, as well as numerous training programmes and social events for around 500 participants.

Medierea, instrument de management

 

In data de 7 februarie 2013, Parisul a fost gazda celei de-a 4-a Conferinte privind Medierea a Camerei de Comert Internationale “Pastreaza controlul! Managementul riscurilor, timpului si costurilor disputelor comerciale prin ADR inteligent”.

Conferinta a fost evenimentul de debut al Saptamanii Medierii organizata de Centrul International ADR al C.C.I. Paris si a fost urmata de a 8-a Competitie de Mediere anuala – un program educational cu privire la mediere de 6 zile pentru studentii de la 66 de universitati din intreaga lume.

Revista profesionala “Medierea Tehnica si Arta” a fost partener media al evenimentului.

La conferinta au participat peste 100 de consilieri juridici interni, avocati de business externi, precum si mediatori certificati.

Temele de discutie anuntate au fost: analiza litigiilor si selectarea celei mai potrivite proceduri de solutionare a litigiului; motivele financiare pentru implementarea ADR si a medierii, ca parte a strategiei unei companii privind managementul controlat al litigiului; cum trebuie sa se pregateasca companiile pentru viitorul metodelor de solutionare a litigiilor comerciale; schimb de know-how privind cele mai bune modalitati de a pune in aplicare si executare mecanismele de solutionare alternativa a litigiilor în cadrul companiilor, inclusiv o „harta a mintii” pentru uzul companiilor.

Conferinta a fost moderata de Hannah Tuempel, Manager al Centrului International ADR al CCI si Christopher Newmark, experiementat mediator, arbitru si avocat, care au rezumat fiecare sesiune sub forma unei “harti a mintii” in vederea folosirii ca instrument de referinta de catre participanti.

Conferinta s-a dovedit un forum cu accent practic pentru a contura procedurile curente de management al disputelor utilizate de catre companii.

Concluzia a fost ca, desi sistemele de management al conflictelor ale corporatiilor sunt inca insuficiente, companiile care recurg la mediere dovedesc un indicator pret-castig real mai ridicat. Doamna Christine Guerrier, Vice-Presedinte Solutionarea Disputelor si Litigii in cadrul Thales, Franta, a relatat participantilor ca bugetul alocat litigiilor de catre Thales s-a redus cu 2/3 gratie utilizarii in crestere a medierii.

Consilierii juridici interni prezenti la Conferinta au subliniat importanta obiectivelor de afaceri in implementarea unui sistem de management a disputelor.

In consecinta, apelarea la remediile legale rareori reprezinta o solutie pentru conflicte, din cauza deficientelor sistemului adversarial: problema reala ramane de cele mai multe ori nerezolvata, in timp ce se adauga costuri cu litigiul si timpul necesar proceselor in instanta. O astfel de conduita este de obicei incurajata de avocatii externi, care vin dintr-o cultura a litigiului.

Reprezentantii companiilor au subliniat necesitatea solutiilor inteligente pentru afaceri in managementul conflictelor. Astfel de sisteme trebuie sa fie sunt intemeiate pe evaluarea timpurie a disputelor si a potentialelor riscuri conexe, pentru a fundamenta o decizie informata de afaceri si a preveni escaladarea conflictelor. Companiile pot utiliza diferite instrumente pentru evaluarea timpurie a conflictului, iar participantii au asistat la o demonstratie facuta in acest sens de Dr. Alexander Steinbrecher, consilier juridic al Bombardier, Germania. De retinut este insa factorul comun al acestor instrumente: valorizarea obiectivelor de afaceri ale companiilor. Asa cum dl. Iain Jacobs, Director al Grupului Contracte, Departamentul juridic, ABB, Elvetia, a spus participantilor, experienta companiei sale este ca si “micile” probleme trebuie rezolvate, pentru a preveni agravarea lor.

Atunci de ce companiile nu recurg mai mult la mediere? Participantii au gasit raspunsul in insuficienta cunoastere si informare cu privire la acest subiect.

Remediile pentru aceasta lipsa se refera la:

  • Training-ul consilierilor interni, echipelor legal si de management cu privire la ce este medierea.

A fost subliniat ca, de obicei, reprezentantii managementului se bazeaza pe consilierii interni pentru informatii si sfaturi in domeniul solutionarii conflictelor; adesea, lipsa informatiilor conduce managementul sa considere practicarea medierii ca o slabiciune in batalia legala. Asadar, daca echipa legal nu are cunostinte in domeniu, selectarea procedurii ADR oportune este improbabila.

  • Integrarea evaluarii timpurii a disputelor in procesul de luare a deciziilor.

Aceasta inseamna pastrarea controlului asupra managementului conflictelor si nu delegarea deciziei catre avocatii externi, judecatori, arbitri. De asemenea, implica si selectarea consilierilor externi in temeiul unor criterii de eficienta a afacerii, si chiar renuntarea la acei avocati care nu cunosc metodele alternative de solutionarea disputelor.

  • Integrarea ADR in cultura companiilor, prin implementarea de directive si politici interne.
  • Diseminarea informatiilor despre mediere si ADR in general prin diverse evenimente, ateliere de lucru, seminarii, training-uri etc., pentru a preveni rezervele publicului general.

Ca o concluzie generala a celei de-a 4-a Conferinte anuale despre Mediere a C.C.I. Paris, as vrea sa incep prin a aminti idea pe care dl. Michael Leathes, fost consilier juridic al mai multor corporatii, a folosit-o in deschiderea evenimentului: medierea este un nou orizont de “intersectie” pe care lumea incepe sa il descopere.

Conferinta a raspuns unei probleme curente a societatii: severa lipsa de comunicare, provocata in primul rand de abundenta de informatii care ne bombardeaza; daca nu suntem capabili sa identificam codul de decriptare si valoarea adaugata reala a unei informatii, factorul liber-arbitru, insarcinat cu procesul de selectie, va face aceasta selectie intr-un mod deficitar. Stabilind procedura medierii ca limbaj comun in solutionarea conflictelor, incercam in realitate sa identificam un cod de decriptare universal care nu mai ridica problema compatibilizarii. Conferinta ne-a ajutat sa devenim experti in selectarea informatiilor utile.

Revista profesionala Medierea Tehnica Si Arta a devenit partener media al Saptamanii Medierii organizata de ICC International Chamber of Commerce Paris 7-13 februarie 2013, respectiv pentru a 4-a Conferinta Internationala privind Medierea si pentru a 8-a Competitie Internationala de Mediere Comerciala.

Infiintata in 2010 de F.M.M.M. Romania, Medierea Tehnica si Arta este revista profesionala lunara editata bilingv in romana si engleza, care a devenit liderul publicatiilor de specialitate din tara si Europa.

A 4-a Conferinta Internationala privind Medierea organizata de ICC Paris (7 Februarie 2013)

A 4-a Conferinta privind Medierea organizata de ICC Paris este intitulata “PASTREAZA CONTROLUL! Managementul riscurilor, timpului si costurilor disputelor comerciale prin ADR inteligent”. Conferinta va examina cum, in lumina climatului economic actual, mecanismele alternative si amiabile de rezolvare a disputelor (ADR) pot oferi companiilor un control mai mare asupra costurilor si riscurilor mereu in crestere ale procesului de solutionare a disputelor. Similar cu primele 3 editii ale acestui eveniment international, Conferinta de anul viitor va prezenta speakeri de seama din cadrul companiilor multinationale, care vor oferi puncte de vedere din practica privind solutionarea disputelor si, in special, procedurile de intelegere amiabila. Vorbitorii vor avea drept obiectiv oferirea de sfaturi practice si instrumente testate pentru imbunatatirea managementului disputelor.

A 8-a Competitie Internationala de Mediere Comerciala organizata de ICC Paris (8 – 13 Februarie 2013)

Competitia este astazi considerata unul dintre principalele evenimente educationale ale medierii internationale. In cadrul Competitiei, studentii de la universitati se confrunta cu probleme complexe in domeniul afacerilor internationale, pe care incearca sa le rezolve prin mediere, realizata pe baza Regulilor ICC privind Rezolvarea Amiabila a Disputelor (ADR). Prin participarea la Competitie, studentii au ocazia unica de a-si exersa abilitatile de negociere si rezolvare a problemelor in medieri simulate conduse de mediatori profesionisti. Mai mult, ei beneficiaza de feedback-ul primit de la mediatorii profesionisti care le evalueaza performantele.

In fiecare an, Competitia atrage echipe de la facultati renumite de drept si afaceri si prezinta unii dintre mediatorii importanti din lume. Pentru a 8-a editie a Competitiei, in 2013, ICC asteapta peste 60 de echipe universitare si cca. 120 de mediatori profesionisti si reprezentanti ai corporatiilor din mai mult de 40 de tari. Pe durata Competitiei, ICC organizeaza de asemenea diverse sesiuni de training si evenimente de socializare, care permit participantilor sa isi impartaseasca experienta, know-how-ul si bunele practici. Recunoscuta in mod universal pentru importanta contributie in cultivarea bunelor practici in domeniul medierii comerciale transfrontaliere, Competitia se bucura de suportul practicienilor, firmelor de avocatura si corporatiilor din intreaga lume.
